Huntington Beach, CA, Friday, April 30, 2004. Leslie A. Kelly announced today that Doyle Yoder, President, DYP, Inc., Berlin, Ohio, has retained the services of and has authorized Raymond Rundelli, Esq., Calfee, Halter & Griswold LLP, Cleveland, Ohio to file a lawsuit in the US Federal Court, Northern District of Ohio, Eastern Division, against Donald E. Green II, Gregory A Payne, American Cigar Cabinets, Inc., dba American Cigar Cabinets and dba Amish Woodworking, Plymouth, Indiana. Yoder seeks DAMAGES AND INJUNCTIVE RELIEF AND FOR VIOLATIONS OF THE DIGITAL MILLENNIUM COPYRIGHT ACT.

Yoder's filing, Case 5:04-cv-00762-DDD Yoder v. American Cigar Cabinets, Inc., has been assigned to Judge David D. Dowd, Jr.

Huntington Beach, CA, July 2, 2003. Leslie A. Kelly announced today on behalf of Doyle Yoder, President, DYP, Inc., Berlin, Ohio, that he has filed a Notice of Copyright Infringement for profits and damages against American Cigar Cabinets, Inc., Plymouth, Indiana, and Corporation President Don E. Green II and Corporation Secretary George A. Payne, both of Plymouth, Indiana. American Cigar Cabinets, Inc. operates a furniture production facility at 25180 CR 52, Nappanee, Indiana. It has used Yoder's copyright registered images for four years to enhance its marketing program and create the connection between American Cigar Cabinets, Inc., the furniture that they sell, the Amish lifestyle and the reputation of the Amish for excellent craftsmanship.

American Cigar Cabinets, Inc. took the cover image of Yoder's Amish Country 1997 Calendar (See above) and embedded its company name and its slogan "Amish Craftsmanship" in an egregious violation of Yoder's rights. In further illegal use, American Cigar Cabinets, Inc. used two other images of an Amish buggy framed by a sunset from Yoder's Amish Country 2000 Calendar to reinforce its connection to the Amish lifestyle. All uses by American Cigar Cabinets, Inc. are egregious violations of Yoder's rights. Kelly is seeking profits and statutory damages of $150,000 for each of the copyright registered images belonging to Yoder. Yoder, the grandson of Amish, has sold his Amish Country Calendars, which document the Amish lifestyle in Ohio, since 1988.

Amish Woodworking took three images from Yoder's Amish Country 2000 Calendar and created its company logo, above, which appears in at least 132 displays within its website. Amish Woodworking also used his image of an Amish buggy framed by a sunset from Yoder's Amish Country 2000 Calendar to reinforce its connection to the Amish lifestyle. All uses by Amish Woodworking are egregious violations of Yoder's rights. Kelly is seeking profits and statutory damages of $150,000 for each of the copyright registered images belonging to Yoder.
