Since the launch of the Alta Vista Photo Finder (October 1998) and the Arriba Vista Image Searcher (November 1998), Kelly has become a quick study in their image acquisition and operations and how it applies to the Digital Millennium Copyright Act (DMCA) of 1998. When his images were infringed, he filed a lawsuit on April 6, 1999, alleging that Arriba Soft Corporation and its Arriba Vista Image Searcher violated copyright laws. During this process, and in numerous copyright infringement lawsuits and other copyright infringement settlement actions, Kelly has become acquainted with how search engines work and the framing issues of copyright law.
